The distinction between murder and manslaughter is intent. To convict him of 2nd degree murder, the jury will have to conclude that Chauvin intended to kill Floyd, but that it was not pre-meditated. That is going to be tough to prove.

Manslaughter was a slam dunk that he serves several years in prison. Now I think it is 50/50 he is aquitted

there have been other posts on this board that say Minnesota juries can convict on a lesser charge

ETA: for all I know... a bump up to 2nd degree may have been a ploy by Ellison to try to better his chances at getting a plea deal negotiated so this never sees trial (which would probably be best for the country as a whole)

He's not getting second degree murder. That by itself will probably set off riots.

If they can, Chauvin will go to prison. If it's all or nothing on murder 2, he's got a very good chance to walk away a free man. I'd say 60-40 he walks at this point.

If it's murder 2 or nothing, then the fault lays at Keith Ellison's feet. He's the AG that upgraded the charges to murder 2. Of course, there are many who are saying he did it on purpose hoping for an acquittal. Then we get more protests and upheaval, which is supposedly what he wants.
