So 1. You need to be able to see that someone resisted the police without saying it is okay for them to beat/kill etc them.
2. He is clearly resisting. They other guy seems to get out of the car. They dead guy clearly doesn't want to which is why the second cop comes over and they still can't move him. WHich doesn't have anything to do with killing him later. But it still appears to be a fact.
