If the victim had not charged the killer than yes, but that opens the possibility that the guns were only to detain. They could make the argument that the first shot was intended to warn him, but he put his hand in front of the barrel. The deadly shot came when they were struggling. I don’t know enough about the legal arguments to say for sure what the convictions will be, but I’m sure that in six months I’ll be as expert in this as I am in epidemiology now.

Put it this way, if one chose to enter into mutual combat outside of Reggie's one night, he probably isn't gonna be very successful with a self defense claim if he decided to pull out a piece and end it that way, even if it appeared as if he was about to get his arse handed to him. To assert that the he was in fear of his life due to other fighter possibly wrestling away the gun that the he pulled out in the first place....that ain't gonna cut it.
