Not entirely true. Jeopardy attaches when the jury is first sworn in. That said, they should go after the douche. I'm not suggesting that they "throw the book at him," but that shite was unacceptable, and he should be required to do 1,000+ hours of community service and pay a fine.

Nah. He should get the exact same sentence that would have been given to the two innocent people he tried to set up. He knew the potential ramifications of his actions and the likelihood that two random innocent guys who had the misfortune of walking in the area that his bullshite took place would be arrested, tried, and convicted. That may not have been his ultimate goal, but he would have sat quietly by and let it happen for his own personal gain.
