It's insane the rights that the railroads have. Protected by federal law, they can do whatever they want, whenever they want.

There's a railroad about 2 miles from my house. A schedule changed and a train that used to come through mid-day now rolls through around midnight. Blaring their horn because of safety reasons. Our local elected officials talked to the railroad about going back to daytime, railroad basically told them to F off.

Interstate commerce.

Was involved in a rather large derailment once and an Illiois State Trooper (sergeant) demanded my drivers license. The other cops around about spit out their coffee when I told him no, he wasn't getting my drivers license.

Handed him a card provided by the railroad that says why we do not have to provide them with that information. He flipped out and said "This is not your license!" I told him to read the part along the bottom.

"See where it says CFR 49? CFR stands for Code of Federal Regulations. You have no jurisdiction."

As he stormed off with his rookie in tow the other cops and firemen were all smirking and later said they were surprised I told the guy to pound sand. They didn't know either.

Railroads are all federal. Locals can scream all they want..

Oh, and if you don't like the horns don't buy a house by the tracks. They've been there long before you were thought of.
