The legislation was orally argues as "not a tax" yes. But the actual written legislation, which is what has to be ruled on labeled the orally argued "penalty" as a tax. That is where the democrats and their lawyers actually carried the day. They knew an oral argument that is at odds with the actual legislation gets ignored.
Like I said the republicans got bitch slapped in front of the court by better lawyers.
