Same question. I also don’t know if this is common practice. He’s not a government employee or official. He is a private citizen working from Trump in Trumps capacity as a private citizen. That’s different than say White House counsel.
ETA: I guess he could be considered like a “ special envoy” or something of that nature?

Trump is the Head of the Executive Branch. He can hire or fire anyone he wants. Rudy works at the pleasure of the President.

I can't go to another country and interview Government Officials? Where is this in our Constitution? Are we Free Men or are we servants to Der Stat? I know you love Der Stat, so no answer necessary.

Do you people REALLY think Presidents never use people they trust in private life as envoys, go betweens or whatever?
I mean hell. What was Jimmy Carter's official position when he was sent to negotiate with N. Korea?
I doubt any President, or for that matter, congress critter EXCLUSIVELY uses people on the govt payroll.
