It depends on the intent. He can have authority and the act still be obstructive.

He can still fire anyone in the EB...it's congress that has exploration and review powers in which they could impeach...

It would be ridiculous to impeach over firing his own people

WTF?

You can do an "illegal" thing without bad intent and (possibly) get away with it.

But, you CANNOT do a LEGAL thing with bad intent and get arrested for it.
