You have to remember that Wade isn't on trial or being prosecuted. He has been asked to be a witness/give testimony in regards to Dawkins who was under FBI investigation. The OP shared what Dawkins was charged with, which seems to be making NCAA violations due to paying student athletes without the universities knowledge. In fact he was just a middle man who seems to be a fall guy for major apparel companies that are actually reimbursing the athletes in exchange for advertisement from university. Dawkins has since been sentenced to 6 months and it appears is leaking these recorded conversations with our coach to show universities were aware of deals made with athletes in an attempt to appeal to public opinion. Unfortunately for them no one really understands this complicated case or knows what is really going on.

OP seems to be correct based on that indictment. Assuming what the US Attorney's are alleging is a correct interpretation of federal fraud statutes, and based on the fact that there are already convictions its safe to say it is, then anyone who knowingly does anything that makes an NCAA player ineligible is committing fraud under federal law. Wow. That is prosecutors stretching the law if ever I've seen it.
It wouldn't shock me if there's some revised statutes or overturns on appeal in the wake of this, because that's a hell of a precedent to set. Regardless, it seems like if Wade gave any sort of benefit to Smart that he knew would make him ineligible, then he is guilty of a federal crime. Smart is guilty of a federal crime. Smart's mom is guilty of a federal crime. Zion's dad is guilty of a federal crime. Colin Sexton is guilty of a federal crime. Deandre Ayton is guilty of a federal crime. Bill Self is guilty of a federal crime.
Yet none of the above have been charged. Despite the FBI clearly being in possession of fairly damning tapes. The question is why? Is it prosecutorial discretion? They know going after the coaches and players will piss people and just don't think it's worth it? Is it because they don't feel they have enough on the coaches? All they have are the leaked conversations and that's not enough to indict Wade. That's why he and Miller have been subpoenaed, so the defense can ask them what exactly those calls were about.
In that case they'll absolutely plead the fifth. Interesting.
