Well...the better action altogether would have been not to pull his gun at all, since the threat was over. But if he was going to pull it, he definitely shouldn't have been running at the other shooter, who was clearly fleeing, with the obvious intent of firing on him.

How could he know that, in that second? And what's the point of having the gun if he can't pull it when he feels his life is in danger?

Why not? You guys lionize these 'samaritans' every fricking day on here. If he had done the exact same thing and shot the initial assailant before the cops got there, you'd be lining up to give him a congratulatory handy.
