The process is you collect from YOUR insurance company and who really cares if they go after the other driver or not, that is THEIR problem.
Seriously, file a claim with your insurance, and they handle the rest. If it's ANYTHING other than that, you have some shitty insurance. I have Shelter and I've been hit twice by assholes who didn't have insurance, both times Shelter took care of everything , even paying for pain and suffering and such and in both cases I know they said they didn't go after the other driver, because how do you go after somoene who doesn't have anything to get? They just write it off as the cost of doing business and raise everyone's rates.
