A Thibodaux woman is seeking more than $2 million in a lawsuit over a crash involving a postal worker.
Evelyn Sims says that on July 17, 2015, she was at a stop sign at the intersection of Plantation Road and Lynn Street in Thibodaux when Charles Chiasson Jr., who was driving a U.S. Postal Service vehicle, rear-ended her.
Sims alleges Chiasson had looked away from the road as he approached the intersection, causing him to run into the back of her vehicle. The lawsuit says his actions were “negligent” and that he “had a duty to exercise ordinary care and operate the motor vehicle reasonably and prudently.”
The lawsuit says Sims filed a claim with the federal government, which has not made any determination.
“However, as more than six months has passed since the claim was presented, this suit is authorized under (federal law), as Plaintiff exercises her option of deeming the government’s inaction a final denial,” the lawsuit reads.
Sims filed the lawsuit March 7 in federal court in New Orleans against the United States. New Orleans attorneys Brian King, Jason Giles and James Courtenay are representing her.
