The FBI doesn't prosecute crimes , they investigate crimes.
And the obvious solution is to waterboard both of them until we have two stories that match and then execute the one who changed their story. Dr Ford is dead, Kav is on the high Court. Life goes on.

Honestly - I think I would. By all accounts he was a party animal in high school and college and I don't buy that interview where said he was virgin all the way through college and law school.
Having said that it's inherently impossible to prove and I'm not willing to derail this nomination becuase he grabbed some arse back in 1982.

One of them doesn’t have to be lying. They will take clues from Hillary and say “to the best of my recollection”, “I don’t recall,” etc.
Memories can be manipulated and they could both think they are telling the truth.
But I would think that the person who didn’t remember it for 30 years is not credible.
