It is legal to add a CC fee. The town I live in does it for the utilities if you pay with a CC. The school district does as well for certain items.
I got my AC replaced this past spring and the company had a cash/check price and CC price.
Tom Thumb gas stations had a cash price and CC price. They got in trouble though, because they did not advertise it that way. Make sure it is upfront and known before transactions.

I've always assumed the business was working those fees into their prices already. If they're not, shame on them.

People are turned off by retailers doing it explicitly.
Easy way around that, pro rata credit / total sales x 3.5% and add it to your prices.
It’s cheesy to add it on to just credit purchases. But again, this all depends on type of business.
If it’s something I might negotiate, like a car or appliance, I don’t expect them to take a card knowing good and well they will lose 2-3% on the deal.
High margin like restaurants, just build it in.

The fee is always passed on to the consumer. It’s just method that varies on how the merchant passes it on.
