Due Process applies to more than just criminal proceedings and clearly this is a criminal action as they are being punished for illegal presence.

Except they wouldn't be punished. I don't believe the US government will hold them in Mexican prisons for illegally entering America

But last week the Dem Mantra was "this is a civil matter not a criminal one".
