This is absolutely an unconstitutional taking of property by the government without just compensation. The Supreme Court ruled on this in 2015 in Horne v. Dept of Agriculture Chief Justice Roberts delivered the opinion of the Court holding in part, "The government’s duty to pay just compensation applies to personal property as well as real property, Roberts said. “The government has a categorical duty to pay just compensa­tion when it takes your car, just as when it takes your home.”

No way in hell this statute, as written above, is not a per se taking of personal property by the Government. They are required to pay you for it.
