I agree up until your last paragraph. They can't cite privileged communications in court (except in limited circumstances some of which may be in play but let's ignore that). Once they've seen something, even if they're not entitled to, they don't have to pretend not to know.

Yes, but what he's saying is this.

Let's say you read the email and it says "the body is in the park under the big oak"

Now you can't just go the park and dig up the body because you have to explain to the court HOW you found that body.

But what you CAN do is is use your knowledge of where that body is to do further investigation.

Heck, I'll give you a real world example from one of my own cases.

We had a arrested a soldier for murder and he confessed, told us where the body was and everything. His lawyer got the confession tossed. The entire thing thrown out.

Well, we knew he did it, and we knew where the body was, but we couldn't develop the case based on anything said in his confession.

No problem, you just have to figure out a different way to get the information . But once you KNOW the information it is easier to figure out another way to get it.

In this case the a simple drug sting set up near the location of the body with a drug dog involved resulted in the discovery of a body.

Perfectly legal.
