Nobody is condoning drinking and driving. Check points should be illegal though. This is not a 3rd world country. I have been to many 3rd world countries. The US is no better than any of them as long as we have check points.

0.02-0.03 BAC: No loss of coordination, slight euphoria and loss of shyness. Depressant effects are not apparent. Mildly relaxed and maybe a little lightheaded.
0.04-0.06 BAC: Feeling of well-being, relaxation, lower inhibitions, sensation of warmth. Euphoria. Some minor impairment of reasoning and memory, lowering of caution. Your behavior may become exaggerated and emotions intensified (Good emotions are better, bad emotions are worse)
0.07-0.09 BAC: Slight impairment of balance, speech, vision, reaction time, and hearing. Euphoria. Judgment and self-control are reduced, and caution, reason and memory are impaired, .08 is legally impaired and it is illegal to drive at this level. You will probably believe that you are functioning better than you really are.
0.10-0.125 BAC: Significant impairment of motor coordination and loss of good judgment. Speech may be slurred; balance, vision, reaction time and hearing will be impaired. Euphoria.
0.13-0.15 BAC: Gross motor impairment and lack of physical control. Blurred vision and major loss of balance. Euphoria is reduced and dysphoria (anxiety, restlessness) is beginning to appear. Judgment and perception are severely impaired.
0.16-0.19 BAC: Dysphoria predominates, nausea may appear. The drinker has the appearance of a "sloppy drunk."
0.20 BAC: Felling dazed, confused or otherwise disoriented. May need help to stand or walk. If you injure yourself you may not feel the pain. Some people experience nausea and vomiting at this level. The gag reflex is impaired and you can choke if you do vomit. Blackouts are likely at this level so you may not remember what has happened.
0.25 BAC: All mental, physical and sensory functions are severely impaired. Increased risk of asphyxiation from choking on vomit and of seriously injuring yourself by falls or other accidents.
0.30 BAC: STUPOR. You have little comprehension of where you are. You may pass out suddenly and be difficult to awaken.
0.35 BAC: Coma is possible. This is the level of surgical anesthesia.
0.40 BAC and up: Onset of coma, and possible death due to
respiratory arrest

Are you trying to say that this level should be illegal?

I agre. I believe check points are a violation of the 4th amendment.
Correct me if I’m wrong. I’ve never seen one or been in one. But if you refuse you go to jail for obstructing or something close right?
I have no issues with cops posted in every street waiting for drunks to leave. But I think it’s a violation of rights to stop a car with reasonable suspicion.

For some yes. Not everyone. I’ve seen fatale crashes with that ammount.
Some cops will push the limits to get a dui at that level. The standard filed sobriety tests should be taken into account at this level. They’re standard for a reason. If an officer sees impairment but not enough to meet the “standard” you shouldn’t arrest because they are above .04 but below a .08.

I’m interested in seeing the results of the national check points per year. How many DUI’s compared to officers time and money.
Don’t get me wrong being a cop I’ll never pass a dui up but to sit and pick cars at check points is wrong.
Getting a drunk driver isn’t hard. The gentleman who posted he got a dui for failure to signal. That example is happens a lot.

None of the description mentions motor skill impairment. That's why that level is not illegal.

That’s not for everyone. You take a seasoned drinker. 4 beers is like water to them.
Now take a person who drinks maybe once a month or less. Now they have 4 drinks in a hour or 2 hour span. They will show impairment more so then a seasoned drinker at .1.
Standard field sobriety tests are established for all types of drinkers. The tests will show for most impaired drivers. You ask me to run the tests at .1 and I’ll pass. Muscle memory.
What I’m getting at is there is 3 typical phases to a dui. Vehicle in motion(swerving, speeding, changing of speeds drastically), contact(smell, speech, etc) and tests. If you show clues of impairment where you meet the threshold of probable cause for arrest then I think the officer is justified regardless of the BAC.

For some it is. The tests usually show impairment. If you’re not impaired, you are going home. It all depends on the laws of each state and how you do on the tests.

People that fail the eye test shouldnt drive. That doesnt mean we should make everyone pull over and take the eye test.
Most check points are revenue related anyway.
They use organizations like MADD to quell the herd while they rake in the dough.

I agree and also disagree to a point. You get one indicator doesn’t mean you are impaired. If an officer conducted the eye test for drugs. I fail. I have a natural lack of convergence.

I agree. Just because the Supreme Court ruled them constitutional doesn’t make it right.

This thing was so big you could call it a block party. And as metioned above they know where the real crime is going down and choose to make $$.

The entire departing audience of a gala performance of Handel's Messiah had to go through that checkpoint. Some ballers will be calling the sheriff Monday morning
