It's not your job to enforce the rules of the road. It's your job to obey them
We've already established that the speeder isn't obeying the rules, he's speeding. IT'S NOT YOUR JOB TO PREVENT THAT. And it's definitely not your job to break another law to make the situation even worse.
And no, it's not his job to tailgate to stop you from breaking the drive right law, either. But this does not change the fact that you are the one who created the unsafe situation.

There is no unsafe situation if there weren't a difference in speed and in that case the speeder is in the wrong. This is where I win the argument.
