So it takes her 2 weeks to report this
Contrary to what you might think, there is a lot of emotional issues rape victims have and generally they don't come forward at all, much less report it immediately. many that do report it immediately end up regretting it

despite the fact that she's allegedly been raped before?
Maybe it happened before, a "he said she said" and after being put through the ringer it made it a tougher choice this time.

Yeah this is bullshite and any competent attorney would rip her to shreds
Can tell all that from the article? Hope youre never on a jury
quote:Often times there isn't if its not reported within 72 hours. That's why rapist are so hard to catch / convict. Even when DNA evidence is present the rapist can always say it was consensual.
If there's no rape kit or physical evidence
quote:For what exactly? Id bet the investigators presented an affidavit of probable cause to a judge who found enough to issue an arrest warrant.
the police better be prepared to get the frick sued out of them.

And the accuser can also claim rape

Guess what? Her identity is hidden. Rape shield laws make sure of that. His isn't. It's his name that's dragged through the mud and he's the one whose image will be forever tarnished, even if he's acquitted or if the charges are dropped. The accuser has effectively ruined this man's life regardless of the outcome of the trial.
And if you think criminal law actually protects someone from being charged with a crime, just do some research. If I were cop or a prosecutor, do you know how easy it would be to get someone charged with a crime? A conviction is an entirely different matter, but once the publicity occurs, good luck rehabilitating your reputation.
