I could see this maybe happening where the officer in the drivers seat was taller/longer legged than his partner in the passenger seat... so his seat would be positioned a few inches farther back. OR the passenger cop could be of slightly thicker build and therefor his legs would be slightly above the guy driving.
So the victim is petite to average for a female (I'm assuming) and is either bent over or crouching while talking to the driver.... The passenger seat cop, with pistol in hand already accidentally pulls the trigger while holding it parallel to his lap... A slight upward angle could result in it going between the drivers torso/steering wheel clearing the driver's legs and exiting through the door below the window.
It's still a complete frick up by officer who fired the shot and he should be charged with some degree of manslaughter at the very least.
ETA:
I think it's possible that he wasn't required have to have his body cam turned until either opening the door on his side of the patrol car or exiting the unit (as long as dash cam and whatever other onboard recorders are turned on).
