The better question is whether he can sue whichever police department released private records.

They're not private in Washington, where the crime occurred. No one ever looked into it because they didn't have a reason, but once he missed the update in Oregon and it was public record, the newspaper found the original crime in Washington.

In other words, you could have found the original crime 2 years ago if you wanted to look for it.
