Seems to be perfectly legal if you are the police...

I would be curious to know if the State of California investigates every video to insure every person in every video on instagram, youtube, facebook, ect... signed a consent form to have their video taken.

A number of states have two-party consent laws when it comes to recording conversations. However, there also has to be a reasonable expectation of privacy. In this situation the recordings were done in public settings, ie. restaurants, so it can be argued that since they were in public settings there was no reasonable expectation of privacy for the conversations.

Further, animal rights groups routinely do undercover recordings of slaughterhouses and farms in order to expose what they view as cruelty and immoral acts. There are criminal charges that get pursued in those cases as well but not against the people breaking the two party consent recording law. This is from the federalist so I'm sure it will be dismissed by a number of you but it really is the easiest source to read about the issue.
