If he wasn't expecting bears in the area, I could see making a mistake. Doesn't mean he should get away clean, because he is responsible for what he shoots, but a black bear and a hog can look very similar, even if you get a good look at it. Compare it to this. If a mule deer walked out at 100yds in LA, you'd almost certainly think it was a white tail, because you wouldn't be expecting a mule deer here. People should be expecting bears now in LA, but in years past they were almost nonexistant, so he probably didn't give it a second thought when a thick, black haired, four legged animal walked out.

I agree I can see how mistakes can be made with bears in areas with pigs. Known people who have come close to shooting a bear mistaking it for a pig.
