That's a great idea, just buy a new SIM from ATT and have them activate it right there. I was trying to use the old one from his 5c.

I'm thinking it was reported stolen or something. Why people continue to get in bed with Apple and lose control of their devices amazes me.
I'd call back and try another agent. If no luck, asked to be transferred.
You legally bought a device and can prove it thru eBay receipt and who you bought it from.
You won't have luck with a BB receipt, IMO. Why would you still have a sealed phone, never opened, and be selling it?
Who cares if it were stolen, tell em to send the pokice and you'll prove purchase.
