The fact that the student took the phone without permission has no bearing on the fact that the teacher brought pornography that was easily accessed to school.
Drugs are illegal, period. Nude photos of yourself are not illegal. Especially when they are stored on your personal property. The phone was her property, she had a reasonable expectation of privacy, and the student accessed the photos by taking the teacher's property into his or her (not sure what gender the student was) possession without the teacher's permission, and then distributed the photos using the teacher's phone, again without the teacher's permission.

The teacher is not culpable at all. Yes, she was careless, but she's a victim here.
