Still the phone running ios9 does not matter bc the FBI is not asking to extract files from a locked phone.
They want user access using a modified version that gives them unlimited password attempts with apples signature. That's it.
And in the other cases, Apple actually helped extract files from a locked iphone

you make it sound like one is better than the other. removing that feature is basically the same as decrypting the phone for the FBI, which apple cannot do.
everyone knows that without that feature that phone can and will be brute forced and unlocked real quick
