Carry on sizes are not law
If it will fit through the x-ray machine, TSA will let you through with it. Doesn't mean you are getting on the plane with it

My carry on carries a week worth of clothes without a problem. I can easily fit it into the overhead. This is a perfect use of the space.
I only put my briefcase above if the flight is not full and there is plenty of overhead space.
