Yeah, it'll be interesting to see how the debate goes. It'll eventually boil down to "how much air above your land is considered your property"

It varies state to state but look it up it's generally around 200' with exceptions for ariel easements.

How would airspace be measured? People have structures and objects of different heights on their properties, and a private airspace cutoff would be invisible and difficult to uphold.
