no one should go to jail for this. Its a horrible accident... one lost his life, and ankther has to live with it. Accidents happen, jailtime will not bring him back or help anyone. I also hate reading where people will not allow their kids to have an atv or be on one. I had some great times on an atv as a kid. Its just like anything else, teach them to be safe. But even still accidents can happen, just like when they begin driving a cad or truck at 16, accidents can happen. Just have to teach them responsible riding practices.

According to multiple news articles he was arrested for vehicular homicide, by definition that means drugs and or alcohol were suspected, at that point it is no longer an "accident". Now I have no first hand knowledge of this event, but if you want to go get drunk and or high, fine, you want to go ride an atv while drunk and high by yourself, fine, but the second you take a child on that ride and endanger his life, that is when you should go to jail.
If it turns out the driver was not impaired then we have a different situation on our hands
