Shooting someone is a lose lose situation, but you are likely to get sued for using rat shot. You will be sued either way, but they have a stronger case if they live to tell the tale. In my CCW class the instructor said its not unheard of for people to loose everything except their lives even in a "good shoot" situation. The defense fees alone are capeable of bankrupting someone.

Yep. And the reality of that situation is that it necessarily means that killing an intruder that you have to use your weapon on is more likely to lessen your troubles than not killing them. So you are effectively encouraged by rational thinking to kill for your own protection as opposed to taking the more humane or merciful route. You are more likely to end up on trial or penniless for not killing someone who intruded your home than shooting to kill from the outset.

Had a former police officer tell my dad and I that if you have to use your weapon on an intruder it is best to kill them outright for your own legal protection.
