He won't get that harsh of a punishment because we technically aren't at war. Haven't been since WWII.
He's been charged, but I doubt he gets convicted of much of anything. It would look too bad on the administration.

I think there's a 0% chance he gets death or life in prison, but I'm certain combat operations would fall under the "war" category. It was called the war on terror after all.
