They don't need hard evidence to prosecute.

If he actually didn't do anything his attorney will have him take a polygraph in order to try and clear the dude of the charges. This case will go to a Grand Jury do to the nature of the alleged crime.

I don't know so I have to ask. If his atty. has him take a polygraph and he fails, is it discoverable and able to be used by the ADA in prosecuting him?
