The brain will fill in the missing details. These people truly believe they saw an animal.

This makes me mad... How in the FKing world do you not verify what you shoot!?! Even if you are hunting brown it's down how do you know where your shot placement is?
Should be charged with 1st degree murder and serve a life sentence..

Damn... I've hunted those woods many times. Sad story.
I know a guy that shot his cousin and killed him, thinking it was a deer... Never had the guts to ask him how this happens though.

Low light; youth and inexperience; being careless by victim.
Sad for the kid. Has to live with it forever.

Just heard on the radio there will be no charges. I really disagree with that...

What would you want him to be charged with? It's obviously a tragic senseless accident but nothing more. The kids gonna be messed up for the rest of his life as it is.
Imagine if it were your brother or father who accidently killed someone while hunting. Would you want them charged?

Accidents kill people all the time in situations where charges are filed

Yea you're right but I guess I just don't agree with it. In this particular situation there is nothing to be gained by locking this guy up for what was a horrible accident. It's not like society will be better off with him behind bars. He could use the experience going forward and give talks about gun safety.
I guess I've grown more sympathetic over the years...

There was a guy here several years ago who mistook a squirrel hunter for a deer and killed him. No charges, tragic accident, etc. he went on to kill 5 deer that year. Didn't mess him up too bad

Well I guess he didn't make the same mistake twice since he ended up with 5 deer

The office recommends that all hunters wear hunter orange
Accident or not, almost every hunter that is mistaken for game is not wearing Orange, whether the accident is on Private or Public property.

So if I accidentally shoot a black bear cub thinking its a hog, which is pretty reasonable, I get the book thrown at me, but if I shoot a deer thinking its a person I get off free???

SHould be charged at the very bare assed minimum with negligent homicide. I would go with manslaughter if that meant a harder sentence.

I think the laws and penalties against killing black bears are there to deter someone from just using "oh, I thought it was a hog" as an excuse.
I don't think there are many cases of someone purposely killing a hunter and using "oh, i thought it was a deer" as an excuse.

No big deal humans aren't endangered so thier obviously not worth the life of s bear

I think criminalizing negligent behavior is poor policy and should be abolished. JMO, and obviously lots disagree.

I think you know that's not what I'm saying.
I just don't think someone involved in an accident like this should be put behind bars.
