If I make a piece of software and sell it (commercial) and that software and it's code, rights, etc is bought by some three letter agency (proprietary), and I wrote my code so as it is not referenced, a one of custom with no identification (nonattributable), then it certainly fits.
But you dont write code, so I dont expect you to understand that simple explanation. We go further if you like, but you're already out of your depth.
