What I'm trying to say is he obviously didn't intend to kill the kid. It was a tragic accident and the grandma may have swatted the weapon. She claims she didn't ,but I have a hard time finding her credible considering the murderer in her family.

He's not being charged with intending to kill the kid.

The police had no right to be there. They botched an investigation, did no due diligence on the property, ignored information from neighbors, and obviously obtained a warrant without proving their case.
These are not simply accidents, they are acts of criminal negligence.
