State has and always will regulate marriage. We regulate how old you have to be to marry. Different states allow for younger people to marry with parental consent, etc. We regulate the marriage of people to closely related. The only question is if sexual orientation is a protected class that would bar the states from regulating it as far as marriage goes. The federal government does not have the power to regulate marriage, that is left to the states. They do, however, have the ability to define protected classes under the 14 amendment's equal protection, which extents to marriage doctrines in every state.

The state's business in marriage is all about money. The state gets the fees and bestows upon the married certain privileges to money in estates and child support and alimony ect.

They should get out of the marriage business and let couples handle these kind of things through contract.

I laugh when I see gays petitioning the government for the right to marry claiming a state marriage means something about commitment or love. They do have a legitimate claim to whatever rights a state marriage protects and bestows since the state has injected themselves into the business.

Nothing keeps two people---or ten people--from saying they are "married" and living with vows amongst one another and living committed to one another. No two bit state marriage license issued by a JP in Mamou is going to mean love and commitment.
