If a convenience store owner in the ghetto was selling phone cards that said 50 minutes but really only had 40 minutes he could go to prison and at the very least would be fricked with by the police. Home Depot is a big corporation. Their consequence for essentially the same act is zero, and for a minute they thought they didn't even have to refund the purchase! Different standards....

You need to look up the theft by fraud statutes. Wanna guess which of your two examples meets the elements???
