Fifth Circuit strikes down Mississippi abortion law

The law was similar in all respects to the Texas law that was recently upheld by a different Fifth Circuit Panel. The only difference was that the "admitting privileges" law would have closed down Mississippi's only remaining abortion clinic in the state.

So now, we wait and see what happens to the Louisiana law. Is it like Texas or is it like Mississippi?

The appeals court panel ruled that a U.S. Supreme Court decision in 1973 established a constitutional right to abortion. The panel ruled that Mississippi may not shift its obligation for established constitutional rights of its citizens to another state.
"Pre-viability, a woman has the constitutional right to end her pregnancy by abortion. H.B. 1390 effectively extinguishes that right within Mississippi's borders," wrote the two judges in the majority ruling, E. Grady Jolly of Mississippi and Stephan A. Higginson of Louisiana.

Im confused about why this would shut the clinic down. Were local hospitals refusing to credential the abortion factory doctors? I find that hard to believe.

I am pro-life but the purpose of the law was to shut down the clinic in a surreptitious way. If a mother had an untoward event during or after an abortion, EMTALA would prevent any emergency room from turning the woman away. Why would it matter whether or not if the abortion doctor had privileges there?

Clinic has to be within a certain geographic radius of the hosital where the physician has privileges.
The doc could probably get privileges, but was he close enough to the hospital?
