No not really, the flight plan for these types of flights are planned by the company, the Captain takes that plan. If he wasn't on his flight plan it isn't uncommon. For example a flight plan will have multiple nav points, I can request from ATC to go direct to point X. Technically I am no longer "on course" per that flight plan. As far as ATC making the flight plan that's false, you file your flight plan with ATC.

Wouldn't the Airline have to file that plan with officials in nations they overfly?
