But you're not being forced to do it and is free to walk away at any time. If you don't like people smoking or an establishment that allows it, don't associate with them and leave it at that.

I say this as someone who absolutely hates smoking and doesn't even drink. Smoking almost killed my father when I was two but he made it through thank god. I just don't appreciate and respect people trying to control private entities when nobody is being hurt, forced to do anything, property is stolen, and/or people are being slandered/defrauded.

This just didn't work, people tried.

So I live right by a bar (actually 7), and when I walk down the sidewalk they are all smoking in front of the bar and BOOM I have to walk through smoke. Am i supposed to not be able to walk down my street without inhaling that stuff?

Smoking does hurt you, this is where we disagree. I think we should have more freedom, and I would never really be for a ban on tobacco. But just like there are something I can't do in public (say have sex), there is a public interest in limiting behavior.

Tobacco use might be one of those things. I am still TBD on it.

Well in the case of a documented, airborne threat to public health, I'm good with it. I also believe in public noise ordinances and statutes against indecent exposure.
