Looks like Justina Pelletier likely to go home

The kid with mitochondrial disease. Her parents were accused of trying to get her unnecessary medical treatment so the state of Mass took her from her parents for a year. Glad it looks like she's going home.
"Staver claims that DCF's concession "completely undercuts their argument."
"She's now getting treatment from Tuft’s medical providers and they’ve agreed to return her to her family," Staver told FoxNews.com. "This really cuts out the basis for why they took her in the first place."
"We're waiting on the judge. At this point, there is no reason to delay," he said. "There’s no reason why he can't act immediately."

Literally, the only way it possibly makes sense is to assume that there has GOT TO BE numerous holes in it that, for whatever reason, the general public is not privy to.

I said in the original discussion about this case that someone needed to give the Judge an "out." This case was all about ego from day one. If he doesn't let her go hom now he should be dismissed from the bench.

I hope they can sue for restitution (right legal term?).

The best part is how the state backtracked. Now they look like incompetent fools as well.

No one has mentioned a gag order of any kind that I'm aware of and this case received a ton of press. That said, there's only so much the medical community can say bc of privacy issues and I doubt the parents would say anything against their side.
However, the bar for removing a child from parents should be high. Foster children are returned to more dangerous homes every day.

My son has mitochondrial disease. This case scares the hell out of me. The hallmark of mi to is waxing and waning. It's a disease on a cellular level. So, while a child may appear outwardly healthy, they can be in very bad shape internally. So many doctors have never even heard of it. I took my son to the ER once following a fainting spell and presented our emergency protocol from our geneticist (blood work and treatment plan). They took us back immediately, ostensibly to prevent exposure of any kind (making me think they understood). We sat in a room for 4 hours without the first person coming in. And the ER was empty minus one other patient. I finally went on a search for someone and found them all at the nurse's station behind a computer screen with a Google page of mito links up. They had absolutely not the slightest clue what his condition was or what to do, which is the reason for the emergency protocol. We left, and I learned a lesson. The only doctor I trust implicitly to make decisions for his care is the one who diagnosed and has been treating him for 2 years. But, when this story cane out, I remembered our ER trip. What if they decided I wasn't making the best choice for my son? Parental rights are being eroded seriously in our country. I hope someone (multiple someones, most especially the judge) is held accountable for this fiasco.

Also, I have to add, everything we do and encounter in life requires energy. From our hearts beating to solving a math problem. To dealing with emotional stress. I think of my son's energy level as currency. What he spends in one area (ie emotional stress) he won't have for another (ie fighting off an infection). We are very careful about how we spend his energy. A few months ago, his doctor questioned my BF about his intents. It made me laugh at first. He's a great doctor but lacks a filter at times. He questioned our future and if he plans to be around forever. My BF sort of stumbled through his questioning. Finally, Doc said "I'm asking for (my son). Because his body cannot handle stress. Keep that in mind. Losing someone he loves could cause a spiral he might not recover from." I can only imagine what this poor girl has gone through without proper medical care and the support of her family.

Why is it the state knows what is better for the kid in this situation? The parents obviously love her and want her back. How often does the the state take kids from single mom crack whore who makes the 7 year old babysit the 4 and 2 year old while she is out getting her groove on?
