I'm not going to say "that's not a bug, it's a feature!" Because it is clearly a bug, but one that provides massive efficiency compared to the alternative. If your phone had to check everytime you sent a text to someone if they had iMessage or not it would be a huge tax on your phone and the servers that handle iMessage.

Easiest way to fix the problem is to do a complete restore of the device (something you should do anyway if you're no longer going to use the phone) and sign into iCloud and remove the device from "My Devices"
