Same exact thing happened to me recently. Item was described as "brand new mint condition" and was clearly used. I think it had been factory refurbished but you could see the wear on it. So I gave a negative feedback. Well, Ebay doesn't like for you to give any negative or neutral feedback. They sent me emails discouraging it and made me wait for like 2 weeks before I could post the feedback.

they want you to give the seller a chance to correct the mistake, before you destroy his credibility.
