He's not making that comparison. He's comparing the logic used to charge a rapist with the logic used to charge a batterer. You have the best sig quote on the Rant, but you're wrong on this one. (Not saying the poster is right, just saying your criticism if it is invalid)

I get what he is saying, Im just not comfortable with any facet of a battery charge being compared to a rape charge. Might not be right or wrong, but i'm just not going to do it. And like I said, I could just shake some of these SOBs, so that clouds my judgement a little.
