But it is not the BOT that is appealing - just one of its members. He did send a letter to all (what 33 members?) informing them of his intentions and inviting them to individually join of which something like 3 others accepted. But the appeal from my understanding wasn't voted on by the BOT either.

Seems to me that it would require a resolution from the BOT or a majority of the BOT members joining the appeal to get much traction if they choose Federal Court.
