Yes, should be eligible if it's E85. I would bite the bullet and consult with a tax professional for assistance if I were you. Depending on your line of work, these things get to be far more expensive if you pursue them personally.

I have a CPA license from another state. I am an internal auditor. They told me they go by the federal statutes. Said there was no state statute.

Just curious , where is the E85 mentioned in state law?

I have read this. What part makes E85 eligible vs. non e85?

Federal Clean Air Emissions Standards.

is the lady on the phone aware that she works for the state and you're referencing a state regulation?

The rep said when my amendment went to the audit department it would be rejected. She said flex fuel vehicles are not recognized by louisiana. Only electric she said....

Get that jazz in writing. It's not correct.

I've heard that the "turbo-tax" defense is not generally accepted by taxing authorties. Do you think they will accept the "tiger droppings defense"?

I received written conformation from the state saying this credit is accepted...

not saying you didnt...
but...
since when has a governmental entity sent out written confirmation that they've accepted your tax credit request from your tax return?

I got an e-mail back from the state saying that E-85 vehicles were eligible and that to use 71F when claiming this credit.
Gave me a number and the persons name sending me the E-mail if I had any questions.
I had already sent in my state taxes, I am going to have to do an admendment.
