The reason it is legal to brew beer (except in Alabama) and not distill liquor is simple. Money.

While there is the potential for danger, distilling is basic elementary level chemistry. Anyone with half a brain and and some copper tubing can distill liquor that is perfectly safe. Spirits have been made for millenia, and the process has not changed.
Just don't mix it with fricking bleach.
