Just from what I know about some of JJ's facial expressions and demeanor and the response that they elicit in people, I would never put him on the stand.
Well, he will be asked very quickly whether he hit Lowery with his feet or hands. At that point it becomes an issue of doctor statements and x-rays. And didn't this guy say that he didn't kick him in the head? (I guess that would be technically true if he hit him in the neck or ear... it is what it is.)
Shoot, with JJ's testimony he might get indicted for attempted murder.

Meaning the GJ will say there is enough to take it to trial. They don't decide these sorts of things, the actual court proceeding will.

I'm not a doctor or anything, but isn't an ear part of the head?
