holy 3 months awesome xbox updated bump! 
and yeah.. guess it was only a matter of time. I love how these big corps can write this stuff into their ToS and then lobby the US Government to make it an arrest worthy offense to break ToS's.. yet we can't do a damn thing as customers.

Most of court jurisdictions don't hold up terms of service agreements because you arent capable of returning the item after you bought it. Example is software. Once the wrap is broken you cannot return yet you get the terms of service after it has loaded in your computer.
Companies use these to make people think they can't sue. Also, it is used to say they knew the risk.
